A clear legal guide to regulation of functional foods.
Jim Prochnow. Patton Boggs LLP, Denver,
Colorado.
Mr. Prochnow’s presentation will focus on what a functional food really is from a legal and regulatory
standpoint. This presentation will include a brief comparison of the existing marketing limitations on what
information can be communicated to consumers about how dietary ingredients and conventional foods,
medical foods, and dietary supplements affect the function and structure of the human body. Finally, this
presentation will examine various governmental and industry proposals to address, specifically, functional
foods as well as much publicized reports about such foods. One of those reports will be the Center for
Science in the Public Interest’s report entitled “Functional Foods – Public Health Boon or 21st Century
Quackery.”
